On not ceding the legal battle

Last week, Amy Otto posted this interesting post on liberty and abortion at Pocket Full of Liberty. I agree with a great deal of it, but there is a pesky area of disagreement that keeps coming up between libertarians and pro-life activists: namely that legislation is the wrong approach. Bolton overturned every state law regulating abortion and allowed abortion through all nine months of pregnancy for any reason. Roe set up the standard that abortion must be permitted for “life or health of the mother,” and Doe defined health to be “all factors—physical, emotional, psychological, familial, and the woman’s age—relevant to the wellbeing of the patient.”
